In so far conducted litigations with the City of Novi Sad, the courts have gradually defined the reasons why the newly-built bus station cannot function and the City of Novi Sad does not bear any blame for that. The first found solution was that the Article 1 of the Contract concluded between the City of Novi Sad and ATP Vojvodina was null and void with the explanation that such a contract put ATP Vojvodina in monopoly position. Then the court decided that the provision of the contract relating obligation of the City of Novi Sad to provide conditions for accsess of the buses to the newly-built bus station was null and void with the explanation that the entire contract was null and void, despite the fact that the contractual provision could be accomplished without putting ATP Vojvodina into monopoly position. After that, the court decided that the City of Novi Sad did not have the obligation to regulate the traffic in the same way based on the General plan until 2021, saying that the consolidated version of the Plan was a valid one. That version is the one in which the bureaucrats reshaped the will of the MPs in the Assembly of the City of Novi Sad.

Although I, as an investor, think that such explanation cannot be legally valid, I am pointing to the fact that the City of Novi Sad was the one which issued the building and use permits for the newly-built bus station and the ATP Vojvodina service, defining the permits not for any real estate, but for the newly-built bus station and service.

That is why the following question can be asked: How is it possible that the City of Novi Sad simultaneously gave me the permission to build a new bus station and service centre, and immediatelly after completion of the investment refused to regulate the traffic, thus practically prohibited my putting these facilities into operation?

Isn’t that a modern way of confiscation of my property?
