The Commercial Court of Appeal overthrew the decision on selling the Service Center along with the accompanying facilities of ATP Vojvodina and, as far as the other part is concerned, the case was returned to be decided again.

The decision was made according to my complaint to the decision made by the Commercial Court in Novi Sad. During the sale of the Service Center, the appeal confirmed the statements given in my complaint saying that the procedure at the Commercial Court in Novi Sad was conducted in accordance with the Law on Bankruptcy, although the case of ATP Vojvodina was conducted in accordance with the provisions of the Law on the Bankruptcy Procedure.

During the sale of the Bus Station and the construction terrain the process rights were violated in such a way that the complaints filed by myself as a trustee, The Commercial Banks and the Attorney General on behalf of the Tax did not reach the Bankruptcy Council as the second instance organ - and that was a significant violation of the procedure rules.

No matter which decisions will be made in the further course of the bankruptcy procedure, this decision proves that I had very good reasons for filing the criminal charges against the Bankruptcy Trustee and the acting judges, and these charges were regularly rejected by the Prosecution

At this moment, acting of the Higher Public Prosecutor’s Office is in progress in the case they themselves formed based on my statements in which I stressed exactly these irregularities in selling of my property.

With good reasons I also sent complaints to Bankruptcy Trustee Licensing Agency (BTLA) claiming that the Bankruptcy Trustee was not conducting the procedure in accordance with the Law. BTLA did not find anything disputable, but I do believe that, according to the last complaint sent to the BTLA Director, they will take this decision in consideration.

This is not the only problem in ATP Vojvodina bankruptcy, the model according to which the rest of the property was sold as well: Bus Station in Irig, Bus station in Bačka Palanka, office space covering the area of 700m2 in the building belonging to NIS bought by Srbijagas... was the same one, but nobody was dealing with that matter.

It is possible that the Prosecution will reconsider these sellings as well, and that the time will come for consideration of the damage caused by the Bankruptcy Trustee and the judges, not only to the trustees but to the buyers as well.
