Although the decision on bankruptcy of ATP Vojvodina made by the Commercial Court deprived me of the right to appeal, my legal team is going to take all the permitted measures in order to undo the decision. Namely, the appeal of the decision by which the reorganizatrion plan was stopped and selling of the property was ordered was, this time, considered only by the Bankruptcy Council of the same court, but not in the habitual way by the second instance Commercial Court of Appeal (CCA).That Bankruptcy Council was managed by the judge Slobodanka Komšić, sister of Jorgovanka Tabaković, Governer of the National Bank of Serbia. Member of that body was also the judge Vladislav Kurtek, who made the disputed solution and who had been The State Security officer. He is the person who has been managing the important cases for many years, and these cases are those in which there is always a lot of property which can be seized for his originators. Nobody knows if the decision made by CCA would be the same, because the appeal pointed at a number of irregularities in so far course of the bankruptcy, but it also points at serious crimes committed by the bankruptcy trustee Nikola Pavlović and Aleksandar Divljak, Credit Agricole Bank banker. Under influence of the state authorities, the court refused to consider the assertions from the appeal. I have been talking for a long time about seizing of my property by those who transferred the state businesses to the private areas. Such a decision made by the Commercial Court deprived me of the right to have fair and just trial. According to the information I have, it is already known which part of ATP Vojvodina will be target of the seizing attempt. Allegedly, the foreign investment funds supported by the Bank stand behind the whole activity but, actually, they are the organizations owned by the people from the very top layers of the state authorities.

They are the ones I am telling to: You will not seize my funds!

The funds have been earned through the years, even in the time when I lived in the state in which all the rules were well known and in which I used to be one of five strongest small businessmen. The funds have their development course from a small company to a big company. I cannot forgive them the fact that they destroyed the investment which employed, without any subsidies and priviledged state credits, more that 600 workers with the perspective of employing another 600 in the second phase.

I am telling to the potential buyers not to be interested in my property too much, because serious court proceedings are behind it and these proceedings can lead to one of the biggest affairs in this part of Europe.

Sincerely Yours,

Ilija Dević, Investor of ATP Vojvodina Novi Sad
